When USCIS Requires Divorce Document Translation

USCIS requires a certified English translation of all foreign divorce decrees or dissolution of marriage documents in the following situations:

  • Marriage-based green card (I-485): Both the petitioner and the beneficiary must submit evidence that all prior marriages were legally terminated. If either party has a prior foreign divorce, a certified translation of the divorce decree is required.
  • K-1 Fiancé(e) Visa: Both parties must provide evidence that all prior marriages have been dissolved. Foreign divorce decrees must be certified translated.
  • I-130 Petition for Alien Relative: When the qualifying relationship is a spousal relationship and either party has prior marriages.

CR-1/IR-1 Spousal Visa: Both spouses must provide certified translations of all prior foreign divorce decrees.
